Scope
These General Terms of Sale and Use apply to visitors of www.mobiletek.pt, as well as to any commercial transaction made through the online store of M T TELEMÓVEIS, UNIPESSOAL LDA, tax number 517277778, available on the site.
Purchasing products is restricted to persons aged 18 or over.
Browsing the site, as well as purchasing any product from MOBILETEK, implies acceptance of these General Terms of Use by the User and the Customer.
MOBILETEK reserves the right to change these terms of use and sale without prior notice; changes are published on www.mobiletek.pt.
Use of the site
The site www.mobiletek.pt is intended for private use only. Reproducing, transferring, distributing or storing the contents of the site without prior written authorisation, for any purpose other than strictly personal use, is prohibited.
MOBILETEK reserves the right to change at any time the information and commercial offer presented regarding products, prices, promotions, commercial terms and services.
Product prices and specifications are subject to change without prior notice.
Despite MOBILETEK's efforts, some products may carry an incorrect price, so we check prices whenever we process orders. If the product price is lower than advertised, we refund the difference. If it is higher, we inform the Customer by email and await their decision to accept the new offer or cancel the order.
All promotional campaigns have limited stock and are intended for online sale only. If a product becomes unavailable or sells out, the Customer is informed of the partial or total cancellation of the order, with the right to a refund of the amount paid.
MOBILETEK is not liable, directly or indirectly, for any information, content, statements or expressions contained in the texts of the items sold on the site. Authorship of product descriptions is the responsibility of the publishers, manufacturers and distributors of the items concerned.
All contractual information is written in Portuguese, as is the information about the items, email communications and the formalisation of the sale.
Applicable law and liability
MOBILETEK Online complies with Portuguese law.
MOBILETEK declines any liability in the event of a breach of the law of the country where the order is delivered. It is the Customer's responsibility to check with the local authorities the conditions for importing or using the products they intend to order.
MOBILETEK is not liable for losses arising from interference, interruptions, computer viruses, malfunctions or system disconnections that may temporarily prevent access, browsing or the provision of services to Users.
Customer obligations
The Customer and the User must comply with and respect these general terms. In particular, they undertake to meet the following obligations:
- It is prohibited to introduce, store or disseminate defamatory, obscene, offensive or xenophobic content, or any other content that breaches general principles of law and public order;
- Keep, and not disclose, the password used to access the site, so as to prevent third parties from accessing their account;
- Not use false identities;
- Provide correct personal data and addresses, so that MOBILETEK can process orders correctly.
Accuracy of data
The Customer is responsible for the accuracy of the data provided to MOBILETEK and undertakes to update any changes to it in their account without delay.
MOBILETEK declines any liability for delays or for being unable to process the order, in particular at the moment of delivery, due to errors or insufficiency in the data provided by the Customer.
Users are expressly prohibited from transmitting insulting, misleading, defamatory or obscene messages or information, or any that in any way infringe the right to privacy or the intellectual or industrial property of third parties, as well as from making available information that may be harmful to third parties or to the site owner. MOBILETEK reserves the right to delete the account of any user who does so.
How to buy
Registering as a Customer is not required to make purchases on the site, and you may check out as a Guest, but the online form must be completed. After that, simply add to the basket all the items you wish to buy and follow every step of the purchase through to completion.
Validating the purchase order presupposes that the Customer knows and accepts the site's Terms and Conditions and Privacy Policy. The data recorded by MOBILETEK constitutes proof of the transactions carried out between MOBILETEK and the Customer. It is MOBILETEK's responsibility to archive the electronic document in which the contract is formalised and to keep it accessible.
As soon as you complete the purchase, you receive an automatic email confirming the transaction. If the details are not correct, you may immediately request a change, or even cancellation of the purchase.
Delivery times
MOBILETEK only processes an order once the corresponding payment is confirmed, and therefore cannot guarantee the availability of items until that processing begins. The estimated delivery time for products in stock is 1 to 7 days.
Shipments are made on working days only. Neither weekends nor public holidays count towards the delivery estimate. In any case, estimated delivery dates are indicative only.
Shipping and postage
Shipping and packaging costs are calculated automatically by the basket, for mainland Portugal and the Autonomous Regions of the Azores and Madeira.
Shipping and postage are calculated according to the CTT rates in force, for the weight of the items to be dispatched and according to the shipping method initially used.
Where orders are returned because the address was unknown, incomplete or wrong, or because the recipient did not collect them, MOBILETEK will only resend the product upon additional payment of the cost of the second shipment.
If the Customer does not accept payment of the postage for the second shipment, MOBILETEK cannot be held responsible for refunding the CTT postage paid on the first order, which failed to reach the recipient through the Customer's own error: an unknown, incomplete or wrong address, or an unclaimed item.
Prices and VAT
The prices of products and services available on the site include VAT at 23%, in accordance with the law in force.
All prices shown on the site apply to it exclusively and may be changed without prior notice.
MOBILETEK is obliged to notify Customers with orders already placed, by email or telephone, whenever the information and commercial offers presented regarding products, prices, promotions, commercial terms and services change.
Jurisdiction and complaints
All purchases made on www.mobiletek.pt are subject to Portuguese law. Any dispute or disagreement over the interpretation of these General Terms will be submitted to the competent Portuguese Court.

In the event of a consumer dispute, the Customer may turn to an alternative dispute resolution body under Portuguese Law 144/2015. CNIACC — the National Centre for Information and Arbitration of Consumer Disputes (cniacc.pt) — has national jurisdiction. For online purchases, the European Online Dispute Resolution platform is also available at ec.europa.eu/consumers/odr. MOBILETEK is not bound to any ADR body by membership, without prejudice to the legal jurisdiction of those named above.
